Terms and Conditions

We reserve the right to refuse any person a place on a trek, at our discretion if, for any reason we conclude, a candidate may not be sufficiently healthy or prepared for the trek. We will refund the deposit amount in full if we are not able to accept a candidate on a trek.

If you have been accepted on a trek and then cancel any time after 30 days, the deposit amount will only be refunded at our discretion depending on the circumstances. 

Despite our, and your best efforts and intentions, things can happen while on the trek. You must understand and accept that travel and trekking in third world countries and at high altitude has inherent dangers and risks.  As a condition of acceptance and your participation on a trek with us, you are responsible for your own actions, health and safety.

You or anyone dependant on you will not be entitled to take any actions or seek recourse for any injuries, loss of life, damages or costs of any kind, including theft of property, medical care or evacuation. Our standard form of waiver of liability is provided as a clickable link : Waiver and Disclaimer Document. This document must be read, understood,  signed by you and a witness and provided to us prior to being accepted for participation on a trek.

A deposit of $300 US ($400 CDN) is required to hold a spot on a trek. The balance of the prescribed amount for a Trek (less your deposit) must be paid in full within 90 days of the scheduled arrival date in Nepal for your trek. Failure to make this payment by the due date will result in cancellation of your place on the Trek and forfeiture of your deposit.

Once you are on the Trek there are no refunds. 

Privacy Policy

We follow privacy protocols in accordance with Canadian Privacy Laws and requirements. We will not communicate, disclose or distribute any private information of our guests that we may keep in our files or records.  We will not disclose your email addresses, name, residential or business address or telephone numbers. We will keep all medical information you may disclose to us secure and private. We will only disclose or release to a third party information that you specifically direct us in writing to so provide. 

We take reasonable and required steps to keep your information private and secure. 

We will not sell or permit any of your information to be released to any third party for the purposes of solicitation or selling any product or service.

Our support staff and contractors are required to adhere to our privacy policies at all times,

Use of images, photographs, videos, testimonials or other communications

During our treks you and fellow trekkers and Sherpa Encounters may take photographs of you and of the group that may include images or video frames of you. You accept, give your permission and acknowledgement that we may use any and all photographs, images, video frames and testimonials from the Trek taken or given by you, by Sherpa Encounters and /or fellow trekkers. Such photos, images, videos and testimonials etc. will only be used by us in our website and not for any other purpose. Such use or publication on our website is completely at our discretion. No further consent or communication with you is required.

We may advise you or notify you, as a courtesy that such images will be posted and used in our website, but we are not obligated or required to do so. You specifically agree and understand that you will not be entitled to any compensation for the use of such images or videos and that you hereby agree that you will not initiate or take any actions whatsoever for compensation, damages, financial or other loss or injury of any kind or nature, against Sherpa Encounters, its principals, contractors or employees in connection with use of such images or videos.  

Consent and agreement on trek discontinuance determination

Sherpa Encounters strives to make your trek a success and to assist you in safely achieving the goals and destinations of the Trek. Despite our best efforts and your own desires, circumstances can arise while on the trek where we assess, for your own safety and that of the group, that you are unable to continue the trek.

You agree and accept that should we make such determination, you will accept our determination and follow our direction as to the most appropriate way to bring you to safety and suitable care. This may include full evacuation, medical treatment, lower elevations, extended rest or other conditions. Such determination will likely mean the end, or early termination, of your trek.

In such circumstances there will be no refunds (partial or full) of any trekking fees paid by you to Sherpa Encounters. You agree that you will be fully responsible for any extra costs whatsoever incurred by Sherpa Encounters, or by you, in connection with the discontinuance or interruption of your Trek.

Waiver and Disclaimer

Once you have a full understanding of the waiver document and the trek you have chosen, you will need to print the waiver and acknowledgement form from the URL link below. Read it carefully, fill it out and sign it in the presence of a witness. The liability waiver form is a binding comprehensive agreement where you or your dependants waive all your rights to make or bring any claim against, or receive any compensation whatsoever from, Sherpa Encounters or any of it's principals, contractors or employees. Your signature acknowledges that you understand and accept the dangers and conditions that are inherent in high altitude remote Trekking. The document must be signed by you, dated, witnessed and submitted to Sherpa Encounters along with your deposit.

You will not be able to participate in the trek with us if you fail to provide us with the completed unaltered waiver and disclaimer document.
